Can a prenuptial agreement be withdrawn?

Published: 10.3.2021 | Updated: 9.6.2024

The spouses can jointly withdraw from the marriage contract. You will have to make a new prenuptial agreement in which you agree to cancel your previous prenuptial agreement. Both spouses' consent is therefore required to cancel the prenuptial agreement.

How can a prenuptial agreement be withdrawn?

Of course, all the formal requirements for a prenuptial agreement must be followed when drawing up this new one: the prenuptial agreement must be in writing. It must be written in writing. It must be dated and signed by both spouses. It must be signed by both spouses and must be signed and authenticated by two unimpeded persons.
Even a new prenuptial agreement that cancels your previous one will only come into force once it has been registered with the Digital and Population Information Office. The registration must take place before the death of one of the parties or before the divorce proceedings are initiated.
