If the heirs of the deceased cannot reach an agreement on the division of the deceased's property, the District Court shall appoint an estate administrator. An estate administrator is appointed upon application by an heir. Each heir has an independent right to apply for the appointment of an estate administrator. A copy of the inventory of the estate must be appended to the application. Typically, an estate administrator is sought when the division of the inheritance cannot be resolved between the heirs for one reason or another.
The suitability of an estate administrator for the task
The estate distributor must be an impartial lawyer. In addition, the estate distributor must otherwise be suitable for the role. Suitability means the training required for the task, and often a lawyer acts as the estate distributor. The appointment of an estate distributor also requires the written consent of the estate distributor themselves to the role.

The duties of an estate administrator
The estate administrator must determine the time and place for the division of the estate and summon the shareholders to a meeting. The estate administrator should try to get the shareholders of the deceased's estate to agree on the division. If an agreement is reached, the division must be carried out accordingly. The estate administrator primarily attempts to bring the dissenting shareholders of the estate to consensus. If consensus cannot be found, the estate administrator will carry out the division of the assets after hearing all the shareholders of the deceased's estate. The estate administrator's task is to act impartially towards all shareholders of the deceased's estate, and they cannot advise one shareholder in a way that harms the rights of other shareholders.
Legal assistance with estate division
Matters relating to the division of an estate are often very complex, and it is advisable to consult a lawyer specialising in inheritance law regarding division-related matters. Their written consent is also required for them to act as an estate distributor.
