Once the will has been drawn up, you can move on to on inheritance. Any of the partners in the estate has the right to request that the distribution of the estate be carried out. The principle is that the succession is to be distributed in a manner agreed between the partners of the estate. However, it is not always the case that the parties to the estate will agree on how to divide the inheritance.
It is very typical that the heirs cannot agree on how to distribute the inheritance. This usually leads to a stalemate in the distribution of the estate.
How to divide an estate when the parties are in dispute?
The estate cannot be divided if the parties disagree on how to carry out the distribution. Unanimity is required for the distribution of the estate. If the partners in the estate disagree on how the deceased's estate should be divided, it is possible to order the administrator to distribute the estate. The distribution of the estate by the administrator is called a settlement distribution. Even if a distributor is appointed, the distributor's task is to try to reach an amicable solution for the distribution of the estate between the partners of the deceased's estate. The end result, however, is that the estate will be divided.

Successor to a deceased person's estate
Any of the partners in the estate is entitled to apply independently to the district court for the appointment of a receiver. The application for the appointment of a liquidator does not have to be substantiated. This is the right of each individual partner in the estate.
The administrator must be a person who is legally qualified to do the job. Usually a lawyer acts as the administrator. However, the administrator must be impartial towards all the partners in the estate.
The distributor carries out the distribution of the estate after consulting the members of the estate and their views. Typically, the executor charges an hourly fee for the work done. The fee is paid from the estate's assets.
In the event of a disputed inheritance, it is strongly recommended that you contact a lawyer specialising in succession law.
